FORENSICS
LITIGATION: Specific experience with process industry litigation with reference to large capital projects, errors and omissions in engineering and design, cause and origin analyses for operational incidents, safety, environmental, and intellectual property. Performed court-ordered plant inspections. Assisted with preparation of both plaintiff and defendant documents. Additional litigation experience includes plaintiff temporary restraints, preliminary injunctions and discovery including answers to interrogatories, mediation presentations, and full-trial preparation.
Analyzed plaintiff and defendant project management and plant performance issues, attended hearings, been deposed, assisted with deposition strategy, and supported client attorneys in real-time depositions. Led investigation teams and prepared expert reports and testimony. Other expertise includes evaluating proprietary technology portfolios.
INSURANCE: Participated with major insurance companies on settlement teams for large and complex industrial claims. Provided technical interpretations and prepared estimates for property damage and business interruption losses.
FORENSICS: Performed laboratory forensics, construction contracts and capital budget evaluations, and cause-origin analyses often required for effective prosecution of legal and insurance matters.
CASE A: Expert Witness: Business Interruption Analysis: Urea Fertilizer Complex; U.S.A.
Provided engineering and management counsel to attorneys representing a contractor who designed and built a cogeneration unit at a large ammonia-urea complex. Organized and directed eighteen professionals to analyze sales, process, mechanical, operation and safety issues for the entire complex. Participated in structured mediation to settlement. [$25 million]
CASE B: Court-Appointed Expert: Insurance and Safety Risk Dispute; Gujarat, India.
Performed a federal court-ordered chlor-alkali plant inspection in India encompassing technology, process design, equipment condition, and operating conditions with respect to state-of-the-art and safety. [Pre-accident investigation: organized, led team of five engineers.]
CASE C: Expert Witness: Accidental Chlorine Release; U.S.A.
Provided engineering and management counsel to attorneys considering representation of 150 plaintiffs exposed to a large unplanned release of chlorine gas from a rail car unloading station. [Attorneys recused themselves from prosecution.]
CASE D: Expert Witness: Vent Scrubber Performance; U.S.A.
Provided engineering and management counsel to attorneys representing an equipment supplier who allegedly caused a chemical plant explosion. [$3 million]
CASE E: Expert Witness: Refrigerant Manufacturing; U.S.A.
Provided engineering and management counsel to attorneys representing an equipment supplier who allegedly caused a chemical plant explosion. This case settled two days before trial. [$35 million]
CASE F: Expert Witness: Petrochemical Manufacturing; U.S.A.
Lead an engineering team investigating facility owner's operations and management actions for a large Gulf Coast petrochemical plant which was allegedly underperforming. This was in support of attorneys defending a major engineering & design contractor. Assisted attorneys taking real-time depositions. [$350 million]
CASE G: Insurance Consultant: Industrial Gas Manufacturing; U.S.A.
Provided cause and origin analysis to insurance companies with reference to high-temperature equipment failures in a partial oxidation system in a Gulf Coast industrial gas manufacturing complex. Provided deposition testimony explaining my report. [$6 million]

Provided confidential insurance settlement advisory services with reference to oil pumping stations, oil refinery facilities and a chlor-alkali complex affected by Hurricanes Katrina and Rita. Involved property damages and business interruption valuation. [$65 million]

Provided analysis and deposition testimony of OSHA and NFPA Regulations for defendants' attorneys with reference to alleged client responsibility for having caused a large power plant fire during contractor welding maintenance work.
